Loyalty Rewards Terms & Conditions

These terms (the “Programme Terms”) describe the Framatics Family rewards programme (the “Programme”) operated by Framatics (“Framatics”, “we”, “us”, “our”) of Atlanta, Georgia. They sit under the Framatics Terms and Conditions, which continue to apply in full. Where the two differ on a point about the Programme, these Programme Terms govern.

Read Section 1 first. The Programme is not running. Nobody is enrolled, no points exist, and every rate, threshold and benefit below is an illustration of how the Programme is intended to work.

1. The Programme is not live and these figures are illustrative

The Framatics store is a working prototype. It is not trading, nothing on it is licensed, and no payment can be taken through it. Terms and Conditions Section 1 sets that out in full and takes priority over everything below.

There is no live rewards programme. No account holds points, no tier has been assigned to anyone, and no benefit described here can be claimed. Any points balance, tier badge or reward shown anywhere on the store is sample data placed there to demonstrate the interface, exactly as Terms and Conditions Section 6 states.

Every number on this page is illustrative. The earn rate, the tier thresholds, the redemption ladder, the expiry period and the caps are written to show the shape of the Programme, not to commit us to those values. They will be fixed, and this section deleted, before enrolment opens. Until that happens no figure here is an offer, a representation or a promise.

We publish the mechanics now anyway, because a rewards programme whose rules only appear after you have joined is worse than one you can read first.

2. Programme overview

The Framatics Family is a free loyalty programme intended for residents of the United States. Members earn points on qualifying purchases, redeem those points for money off a later order, and receive the member benefits set out below.

The Programme is offered by Framatics only. It is not operated with, sponsored by or endorsed by any school, athletic department, conference, league, team, publication or publisher referenced anywhere on the store.

3. Eligibility

Participation is intended to be open to any individual who, at the time of enrolling:

  • is a resident of the United States;
  • is at least 18 years old, or the age of majority where they live; and
  • provides accurate and current information when enrolling.

Membership is personal. It may not be sold, transferred or assigned, and one person may hold one membership. A membership may not be held by a business, and purchases reimbursed by an employer or other organisation would not earn points.

An individual who meets these requirements and is enrolled is referred to below as a “member”.

4. How enrolment would work

Enrolment is intended to happen through a Framatics account: creating an account enrols you, and an existing account can be linked to the Programme from the account area.

We would use your email address to tell you about your points, so keeping it accurate would be your responsibility. Nothing about enrolment is available today, because accounts on the store are an interface demonstration rather than a live customer system.

5. Ways to earn points

The table below shows the intended earning events. Every value in it is illustrative.

We may also run occasional point multipliers or one-off earning opportunities. Those would be announced with their own conditions and would not change the rates above outside the period stated.

6. Membership tiers

Tiers would be reached on qualifying spend over a rolling 12 month period beginning on the date you join, are placed in a tier, or move up a tier. To hold a tier you would need to meet its threshold again within the 12 months following that date. Returning a purchase that qualified you for a tier removes that spend, and can therefore move you back down.

Thresholds and benefits below are illustrative.

Free shipping is listed as a member benefit at every tier because non-members would pay shipping below the order threshold set out on the Shipping and Returns page. That page is not built yet, so no threshold is stated anywhere on the store today.

7. Redeeming points

Points would be redeemed for money off an order at fixed levels. The illustrative ladder is:

  • 500 points for $5 off
  • 1,000 points for $10 off
  • 1,500 points for $15 off
  • 2,500 points for $25 off
  • 5,000 points for $50 off
  • 10,000 points for $100 off

Redemption would require being logged into the enrolled account at checkout, and a maximum of $100 of points could be applied to a single order. A discount generated from points could be used once.

Points have no cash value. They are not property, they cannot be exchanged for cash, and they cannot be sold, transferred, gifted, combined across accounts or willed to anyone. Only the person paying for an order earns points on it.

8. Expiry, forfeiture and stacking

Points would expire 12 months after the date they were earned if they had not been redeemed before then.

Points would be forfeited if the account is closed, and may be revoked where they were obtained through fraud, error or a breach of these Programme Terms.

Offers do not combine. Where more than one discount could apply to an order, the best single available discount applies. That is how the store is configured rather than a restriction applied by hand, and it means points could not be redeemed on top of a promotional code or during a sitewide automatic sale. A sale period would not extend the expiry date of your points.

9. Returns and adjustments

If an order is returned or cancelled, the points earned on it would be removed. If the removal leaves the balance negative, the balance would show as negative until further points are earned.

If points were redeemed against an order that is later returned, those points would be returned to the account, and the refund would be for the amount actually paid rather than the pre-discount value.

Returned spend also comes off the total that qualified you for a tier, as set out in Section 6.

10. Changing or ending the Programme

We may change these Programme Terms, the earn rates, the tier thresholds, the redemption ladder, the expiry period and the benefits at any time, and we may suspend or end the Programme. Where the law requires notice of a material change or of the Programme ending, we will give it.

Changes take effect when posted on this page and the date at the top is when they last changed. Continuing to take part after a change is your acceptance of it.

Because the Programme has never run, nobody currently holds points that a change to this page could devalue. That will stop being true on the day enrolment opens, and from that day we will treat changes to earning and expiry as changes that need notice.

11. Ending your membership

You could leave the Programme at any time by closing your account or by asking us at framatics.us@gmail.com. Unredeemed points would be forfeited on leaving.

We may suspend or cancel a membership, and revoke unredeemed points, where we reasonably believe there has been fraud, abuse of the Programme, or a breach of these Programme Terms or the Terms and Conditions.

12. Personal information

Personal information you give us in connection with the Programme is handled under the Framatics Privacy Policy.

Two points from that policy matter here. Framatics intends to sell and share personal information as those terms are defined under California and other US state privacy law, and a loyalty programme that gives a price benefit in exchange for personal information can amount to a financial incentive programme under the California Consumer Privacy Act. The Privacy Policy discloses both and sets out how to opt out. Opting out of the sale or sharing of your personal information would not cost you your membership, your points or your tier.

13. Taxes

You would be responsible for any tax arising from your participation in the Programme. Points redeemed as money off an order reduce the taxable amount of that order; we do not treat points as income to you and we do not issue tax reporting for them.

14. Liability

To the fullest extent permitted by law, Framatics is not liable for indirect, incidental, consequential, special, exemplary or punitive damages, or for lost profits, arising out of the Programme.

Nothing in this section limits liability that cannot be limited by law, including liability for fraud, for death or personal injury caused by negligence, or under any consumer protection right you have that cannot be waived. The general limits in Terms and Conditions Section 12 also apply.

Because no points exist and no benefit can be claimed, no member can currently suffer a loss under this Programme.

15. Governing law and disputes

These Programme Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules, and disputes are brought in the state or federal courts of Fulton County, Georgia. Terms and Conditions Section 14 sets this out in full and applies here unchanged.

There is no arbitration agreement and no class action waiver in this Programme. The rewards terms of larger retailers commonly include both. Terms and Conditions Section 14 says that if either is ever introduced it will appear there first and will not apply retrospectively, and that remains true. Nothing on this page changes how you may bring a claim.

Before bringing a claim, please write to framatics.us@gmail.com. Most disputes about a points balance are a record-keeping problem and are faster to fix directly.
